Thomas wasn't in a good place mentally when he signed those papers. Hope and Brooke knew that and took advantage. That in itself brings into question the validity of the entire document/agreement.

But the thing is, it was years ago that Thomas signed the papers and he never tried to get that reversed. In fact, none of the Forresters even tried. Because they knew it was the best thing for Douglas. They said so when it came out at the Thomas/Zoe wedding that Thomas was still sick. Ridge even apologized to Brooke for not listening to her about Thomas.

The time for Taylor to question whether Thomas signed under duress was back then. But, of course Taylor was no where to be found at that time because she couldn't bear to see Ridge with Brooke.

I remember it was before Hope pushed him into the vat at Forrester. So it was 3 years ago, a lot more in Soap time. Why hasn't Thomas torn the adoption papers after his surgery, if wanted to contest the adoption? He only wants Douglas back now because Taylor and Steffy suggested it, and because his feelings for Hope are coming back and he needs a new tactic to manipulate her. But at the same time, Hope is allowing him. She isn't innocent. The minute Thomas revealed his feelings, she should have gone home and told Liam.
