I'm not a lawyer, I don't even play one on TV.

But Thomas knows what he has done in the past. We know what he has done in the past. So surely he would not seek any kind of legal custody or any sort knowing this and that it probably will be held against him. That would be devastating to both him and to Douglas if he is looking forward to living with his father.

But we do know how the program does overlook and rarely mentions some past bad deeds, even criminal ones, so this could be interesting.

Right. Thomas knows that Hope can give the judge a laundry list of horrible things he's done.

Maybe it doesn't even get to court. I guess the issue could be resolved in some other way.
