Adoption laws in California? (General Discussion)

by LiveThroughThis, Saturday, January 12, 2019, 10:56AM (9 days ago)

Sorry if this has been discussed already but I can’t see how this adoption is going to play out without it being obviously illegal - aren’t there laws that limit the cost of money you can pay to adopt a child, so as to avoid it seeming like you are buying a baby? Also, you aren’t supposed to just hand over money - only supposed to pay legal/medical fees (and maybe accommodation and living costs for the duration of the pregnancy, which isn’t relevant here as this baby is already born).
How is Taylor going to justify giving $200,000 to Reece - call it a finders fee and pay him under the table so Steffy doesn’t find out?! Seems to me that anyone aware of the amount of money changing hands has to know what they’re doing is illegal. It feels like it’s leading up to Taylor and Steffy buying a baby, which is super disturbing, regardless of whether it’s Beth or not.

Whoever’s baby it is, you can’t just swap it for $200,000. So how does Reece get his money?

Given Reese has access to hospital facilities, it would be pretty easy for him to fabricate a birth certificate.

In Brad Bell's world ONLY the rich are right, good, honest, moral, above reproach, religious, can get AWAY with ANY and ALL illegal activities, he truly believes, from HOW he portrays them, that poor people will do ANYTHING for the all mighty buck, abuse their families, sell their children, break ANY and ALL laws, because being wealthy is being BETTER, being perfect, like him.

On Soaps there many people are willing to commit to bribes, to do illegal things for bribes/ money:

- the doctor that Stephanie bribed so that he would help her to pretend she had had a heart attack (and TRIDGE got married)
- the doctor that Bill bribed so that the doctor would use someone else's MRI to let everyone think that Steffy has a blood clot and could die if being stressed
- the doctor that Stephanie had paid to care for her daughter Angela in secret, and who later tried to cover up that Angela had died under his care because he had been careless and who had someone pretending to be Angela, so that Stephanie would continue to pay.
- Amber's friend in the hospital lab, who helped her to sabotage the paternity testing during Amber's pregnancy
- Thomas false claim/his lie that he remembers that he had sex with his father's wife on the island (Stephanie promising him her shares if he agrees to lie to his dad)

or blackmail:
- the warden that Bill blackmailed, so that the warden let Deacon out of prison.

or to cover up their own mistakes:
- when the hospital tried to cover up that there had been a mistake during the IVF and they had used the wrong donor egg.

or anger:
- Taylor secretly getting into the patient files of another doctor and getting confidential information about someone who wasn't her patient, who had never agreed for Taylor to have her medical file, because Taylor was upset about Brooke and suspected that Brooke had had an affair with Brooke's brother-in-law.

-> should Dr. Reese commit a crime, it would be at least partly because of his daughter being threaten (love of a parent).

Nothing about this sl is even believable . Heck those papers that Reese bought to Liam to sign could have been papers signing baby over for adoption. In his state of grief Liam may have signed without even reading them ( although it wasn't shown that Liam even signed them) Knowing Bell details or legality don't matter he just expects viewers to accept without questions.

She will probably have Carter take care of it. He screwed up Lizzie’s adoption, he can be counted on for shoddy work. Just what an illegal adoption needs.

I am sure in real life there might be rules/ laws - but B&B always does things its own way.

In real life it wouldn't be possible to have a divorce and then to get married by a Catholic priest in Italy right after the divorce had been finalized.

Sometimes B&B follows the rules of CA and a divorce takes 6 months
- > but in 2011, when Whip and Taylor got divorced and Brooke and Ridge, it was more a matter of weeks
- both "divorces" being done in almost just a month (despite the fact that both couples had been married for more than a year), than the 6 months they usually take in real life and on screen.

Nowadays, Bell seems to have given up on having such magic divorces that are unbelievable superquick (and defy the laws of CA) and instead he writes them as annulments:
On B&B annulments now get treated as the fastest and easiest way to end a marriage. Annulments never get questioned, never take much time (the former spouse is able to get married the same week he/she has filed for an annulment).

We had several people grieving the deaths of there loved ones (and you need documents - death certificates), who supposedly had died in hospitals - just to turn up alive again (Taylor, Felicia).

This has been my thought as well - isn't this totally illegal ?!

You can't sell babies in California

And if this is little Beth, as she rather appears to be, there will only be a simple DNA test to show who the true parents are. Any baby being trafficked in this manner would be horrific, but this is a close family member !!

Are there not amazing legal penalties for doing something like this ?

:rules

There is quite a bit of information available online regarding adoption laws. In case of private adoption, the type of fees you can cover are: medical, legal, counseling, living. However, payments in connection with placement for adoption or consent to adoption are prohibited. Given the latter, I don't see how Taylor can make a one off 200k payment to Reese in exchange of the baby. Furthermore, the average cost of private adoption usually totals at around 37k. While obviously, such costs may vary from one case to another, I just don't see how 200k would be justified as it appears way off.

In brief, just writing a cheque to Reese or Flo for 200k seems more like buying a baby than covering costs for the birth mother. I don't know what Bell's intent is but it does come off as a purchase at the moment. It could be lazy writing though. I guess we will see in the upcoming weeks.

If Taylor and Steffy pay $200,000 for the baby with no questions asked then they will deserve the pain they will feel when they have to give her back to Lope.
