Looking down a hill and smiling as she dies is intentionally making her death certain. Making sure EMS didn't come in time to revive or save her, that's intentionally killing her. As for the texting, it has been shown that she had both hands on the wheel 10:00 and 2:00 and she was watching the road until Thomas started flashing his lights and brights and she started telling him to get off her bumper, and she kept looking in her mirrors. That's thomas, not a cell phone.

There's no excuse for just standing there and not calling 911. That was sociopathic. He had a one track mind ruled by his obsession. Personally, I just don’t care when Emma’s hands were and weren’t on the steering wheel. She was distracted driving. Texting involves visual, manual and cognitive distraction. I often text with my BFF while I’m making dinner and when I put my phone down and walk across the room to take care of things on the stove I’m thinking about what she said and/or what I’m going to write next; my cooking is on autopilot. Emma picked up her phone to text and put it down twice, debated whether or not she should tell Hope via text, talked out loud to “idiot” Thomas, and spent a whole lot of time looking in her her rear view mirror instead of flipping it to the night position and paying attention to the road in front of her. Would she have been doing any of those things if not for Thomas? No. Would she likely still be with us if she had not made those choices? I think so. That is just not how I handle tailgaters, and this storyline has only reinforced my determination to ignore them and double down on driving carefully when I encounter one (as I did this afternoon, lol).
