It should disqualify any of these writers from writing for TV again. There is no logical way to explain why Thomas as a character would risk losing custody of his son.

Yes, there is. They've decided that Thomas is still going to be the villain of this show. He's been a villain for years now, so why change it?

The writers will sacrifice anybody over Steffy. If Thomas can do the dirty stuff...she won't get her hands as dirty in these schemes.
